What Is Considered Assault or Battery in Florida?

Under Florida law, assault is known as a threat, either a word or action, to physically harm another person. This threat must be accompanied by the apparent ability to carry through with that violence at the time the threat is made, and so instill fear in the alleged victim that he or she will be harmed. If you are convicted of simple assault, you could face up to 60 days in jail, 6 months of probation, and fines of up to $500.

You can be charged with battery for grabbing someone, throwing something at them, or hitting, punching, kicking, or otherwise striking them—whether or not the alleged victim was injured. Simple battery is a misdemeanor that could mean up to 1 year in jail, 1 year of probation, and up to $1,000 fine.
